Chances are your work has filtered through to some wallpaper site, who are displaying work as "free, stock photos" that any one can use. So it may in fact be the problem of wall paper sites.

I know for a fact that this is a problem, and have found my own work on such sites with any watermarks and logos removed. Unfortunately the source is very hard to chase.

However that doesn't mean that this isn't wrong, and as the company stand to be making a profit, partly through your artwork on their packaging without permission - you have a very real case.

The problem is you mentioned is a chinese product? In that case you probably have no chance of winning, as China care not one bit about copyright laws, and have got away with copying from far larger corporations with no punishment, such as BMW (copying an entire car) and apple (GoodFone i5 for example). Any case that has ever got to caught has simply been ushered away. So if massive multimillion dollar companies don't stand a chance, I doubt there is very much you can do other than perhaps threaten them with discrediting their name and legal action. Perhaps the thread will be enough to come to some sort of agreement

Also I think it could be a good business this, for future for you, they say they want you to do more work for them, so sugguest that you would like some compansation for the picture they have used until now, and that you agree to do more for them, this is a golden chance for you to get your artwork out there fast ;)

I will buy this RC kit next year, so I hope to see your work on it in the future =D

This is good for you ,

What i would ask for is % of each sale , lets say 20€ for every kit they sell with the design, this way you get continuous income ;)

Or you can just say a fixed proice for the rights to your design for around 300€ example =)

Its up to you really what you do I am glad you get this fixed, and I am glad i found it =)

Also ASK for a RC chassie as a compansation this chassie is REALLY good, and send it to me haha :P

If you can find out what price the kit sells for, then I agree, work out a reasonable percentage (I'd imagine it might be about 5% maximum) or, as glacius said, give a fixed price that you sell the work for so they can use it as much as they want.

Perhaps give them an option, something along the lines of "5% commission per sale OR $xxx in total - which ever suits you best, but there is room to negotiate". Given that they are a small company my feelings would be that they will go for the 5% commission as they won't want to pay fairly high sums up front.

But whatever you decide I wish you the best of luck :-d
